Born and brought up in New York City, McCarthy attended the Cardinal Hayes High School in the Bronx borough. He was the oldest amongst his six siblings.

After college, McCarthy was appointed as a Deputy United States Marshal in the Federal Witness Protection Program. He studied law at New York Law School while working at the US Marshal’s office. After finishing law school, McCarthy started working as a paralegal for the US Attorney’s Office for the Southern District of New York. 

McCarthy was later hired as a prosecutor at the Southern District and worked directly for Rudy Giuliani who was the then US Attorney for the district. Over the years he made quite a reputation for himself as a prosecutor by investigating and leading the prosecution in major terrorist trials including the 1993 World Trade Center Bombing and the 1998 bombings of the United States embassies in Kenya and Tanzania.

He currently works as an op-ed columnist for the ‘National Review’ and ‘Commentary’. He is currently serving as the Director of the Center for Law and Counterterrorism for the Foundation for Defense of Democracies. He also makes regular appearances on Fox News.

He has been a supporter of controversial figures like Rudy Giuliani and Donald Trump and even served as Giuliani’s attorney for his 2008 Presidential Campaign.
